Government Unveils Tough 2025 Traffic Rules to Boost Road Safety

The government has proposed a sweeping set of traffic rules aimed at strengthening road safety and vehicle regulation across the country, according to a special issue of the Kenya Gazette published on Wednesday.

In Gazette Notice No. 7856, the Cabinet Secretary for Roads and Transport announced the preparation of Regulatory Impact Statements under the Statutory Instruments Act.

These relate to four key sets of rules: Motor Vehicle Inspection Rules, School Transport Rules, Drink Driving Rules, and the Operation of Commercial Vehicles Regulations all scheduled for implementation in 2025.

Mandatory Vehicle Inspections Every Four Years
The proposed Motor Vehicle Inspection Rules, 2025, seek to establish a clear legal framework for regular inspection of motor vehicles.

“The main objective is to provide structured legal framework for the inspection of motor vehicles aimed at promoting roadworthiness, reducing emissions and enhancing the overall safety of road transport,” the notice states.

The rules propose mandatory inspection for vehicles every four years, and for all commercial, school, and public service vehicles.

They also outline procedures for licensing of private inspection centers, post-accident inspections, and penalties for non-compliance.

New Regulations for School Transport
The School Transport Rules, 2025, aim to professionalize the transport of school children by setting minimum safety standards and licensing requirements.

According to the Gazette, the objective is to provide a comprehensive framework for the safe, professional and regulated transportation of school-going children in Kenya.

Under the new rules, school transport providers will be required to install seat belts, fire extinguishers, and telematics systems in their vehicles.

Additionally, the rules prohibit use of school vehicles for unauthorized private purposes and will regulate the conduct of drivers and attendants.

Stricter Anti-Drink Driving Measures
The Drink Driving Rules, 2025, are intended to bolster enforcement against alcohol-impaired driving.

The rules will prescribe legal alcohol limits, authorize breathalyzer and blood tests, and introduce legal consequences for refusal to provide specimens when requested by police.

The notice adds that the framework will provide a graduated penalty regime for repeat offenders including suspension and revocation of driving licence.
