The Law Society of Kenya (LSK) has expressed its strong opposition to Chief Justice Martha Koome’s plans to engage in dialogue with President William Ruto.
The LSK President, Eric Theuri, emphasized that such talks would be a mockery of the Judiciary if President Ruto and his deputy, Rigathi Gachagua, do not withdraw their recent utterances undermining the independence of the Judiciary.
During a protest by Mombasa lawyers against Dr. Ruto’s remarks, Mr. Theuri stated,
“The Chief Justice should not have dialogue under any circumstance with the Executive over this matter.
The proper thing for the President to do is to withdraw those remarks and apologize to the people of Kenya.”
However, the LSK is deeply concerned about the impact of President Ruto’s remarks on investors’ confidence in the impartiality of the Judiciary.
It believes that these utterances contribute to a perception of corruption and the Judiciary being subservient to the government.

The LSK stands in solidarity with the Judiciary in defending the Constitution and the rule of law.
“We take the position that the CJ should not kowtow to the Executive by submitting herself for dialogue, “said Mr. Theuri.
According to the LSK, the planned dialogue does not align with Kenya’s constitutional architecture.
President Ruto, on the other hand, expressed his readiness for talks to address “corruption, vested interests, and saboteurs” of his development agenda.
However, Mombasa LSK chairperson, Natasha Ali Errey, raised concerns about the chosen route for the dialogue, stating, “While dialogue is a show of good faith, we are apprehensive that the route chosen to do so is not envisioned by our constitution. We call on the CJ to ensure that any engagements on this are as per the constitution.”
The LSK’s opposition to the dialogue between Chief Justice Koome and President Ruto highlights the importance of maintaining the independence and integrity of the Judiciary.

The society believes that withdrawing the controversial remarks and upholding the Constitution are essential steps towards preserving public trust in the judicial system.
Therefore, the LSK firmly stands against the planned dialogue and urges President Ruto to retract his statements, while emphasizing that the Chief Justice should not engage in dialogue with the Executive on this matter.
The society calls for adherence to the constitution and the protection of the Judiciary’s independence in order to safeguard the rule of law in Kenya.
