Prominent city lawyer Ahmednasir Abdullahi has taken a swipe at the judiciary over what he terms as a broken system.
Through his twitter page, the flamboyant lawyer observed that the judiciary is being faced by a raft of challenges including the shortage of judges.
“In a typical day in our courts, 80% of the cases listed on the daily cause list do not proceed to a hearing for a variety of reasons including, the judge is sick, is on leave, is attending a workshop, has travelled overseas, took kids to school up country, was transferred from station, because list is too long, don’t have enough judges.
Broken system. “tweeted the lawyer adding that chief justice Martha Koome is transparently clueless on the happenings at the judiciary.
The judiciary has in the past taken the heats over delays in hearing and bringing closure to cases brought before them owing to shortage of judges. In 2019, the judiciary in its own admission indicated that the apelet Court faced an imminent shutdown over shortage of judges as stipulated in the Constitution, the Court’s President Justice William Ouko has said.
Justice Ouko said the number of Appellate judges has shrunk from 27 in 2010 to the current 12 at the time. This owing to the refusal of former president Uhuru Kenyatta to appoint 6 judges, a move that was a frosty relationship between the executive and the judiciary.
President William Ruto would later appoint the six judges rejected by his predecessor, saying there was no basis to fail to appoint them as recommended by the Judicial Service Commission (JSC). The judiciary seems to be still grappling with the very issues even as Kenyans with cases in courts decry the long time they spend before the cases are ultimately heard.
